Live Streamer Records Own Arrest During Kelly Thomas Protest; Footage Survives Despite Camera Confiscation (Updated) 304

Fullerton police began making random arrests during a protest against the Kelly Thomas verdict Saturday, including pouncing on an independent journalist who was live streaming the action.

Although police managed to turn off PMBeer’s camera, whose first name is apparently Patti, her footage remained accessible on the internet, which you can see above.

PMBeer had been live streaming for more than an hour before that, reporting that police had arrested other photographers as protesters and police squared off with each other in the streets.

But the protest seemed to have winded down by nightfall after they had congregated in a park at the same bus depot where Thomas was killed.

However, an activist told PMBeers that undercover cops were arresting protesters for no apparent reason as they were walking away from the depot. Eventually, more cops came swarming to make arrests.

PMBeers followed the cops making the arrests, trying to capture it on her camera when she was arrested herself.

The footage is dark and grainy, but it is pretty obvious she was not interfering in anyway.

Police told the media that they arrested ten people altogether on Saturday, including three people earlier in the afternoon, one person accused of assaulting a television cameraman.

But the remaining seven were arrested for failing to disperse, they said. And that, of course, took place once the media cameras had left.

According to KABC:

Police Sgt. Jeff Stuart says Saturday’s demonstration drew about 200 people.

Overall, 10 people were arrested. He says one person was arrested in the cameraman’s assault and two others in spray painting an obscenity and an anarchist symbol. The remaining seven were arrested on failure to disperse charges.

Officials said they did everything possible to accommodate the protestors, but were forced to take action when demonstrators turned violent. Officers responded in riot gear to disperse the crowd.

You can see PMBeer’s entire live stream below to find any evidence of this “violence,” but in the video above, which is the two-minute clip leading up to her arrest, the only violence is coming from the cops.

UPDATE: Below is footage from KCBS showing a protesting wearing a bandanna over her face attacking a news videographer for apparently trying to record her protesting, indicating she doesn’t have the intelligence to be protesting an issue where the goal is to raise awareness.

For someone being so camera shy, Dianna Jordyan Carrol didn’t seem to mind smiling for her mugshot. Idiot.

    Yeah, something tells me this won’t go over too well with the courts. Failing to disperse? Why should people disperse when they are breaking no laws and exercising their right to protest? A failure to disperse order can be given for loitering but since these people were not loitering, they are under no legal obligation to disperse. They had a purpose to be there and that purpose was to protest. I hope each and every person that was arrested fights these cases. We can’t allow the Fullerton cops to get away with this too.       As you can see, the fact of a woman attacking videographer, who was shot on camera, was sufficient, and police “may order PARTICIPANTS AND such other persons to disperse”. Normally, the police uses their own provocateur to do something like that, and this is enough for ordering the whole crowd to disperse, and to start making arrests 10 seconds after. It’s not new.

    I personally know the reporter. We (her friends) are very concerned for her safety. She has a son who is dependent on her for his basic needs. The Fullerton transportation center has no time restriction on which you can be there. There was no reason for the FULLERTON PD TO COME IN AND SNATCH PEOPLE

        Yes, my friend and I were at Kelly’s corner. We were thinking about leaving when undercover agents came out of an unmarked van and snatched him. I was filming his arrest and then they came and snatched me. Most of the people arrested for failure to disperse were in the act of leaving when they were kidnapped by undercovers in an unmarked van. The dispersal order happened blocks form where the arrests were made. We had already dispersed.

      Nobody in Brevard County Florida the 18th Judicial Circuit is ever, ever read their rights and I’ve tried under two elected Sheriffs to train or force their Deputies to do this! I made it a public request of the newly elected Sheriff on talk radio, he just blew it off along with Bill Mick the talk show host, who beat a guy in handcuffs when he was a cop in West Virginia! I’ve brought it up in front of the courts also. I have documented video of everyone I’ve asked out in front of the courthouse if they’ve ever been read their rights!         Cops aren’t REQUIRED to read you your rights upon arresting you. It’s perfectly possible to be arrested, arraigned/indicted, tried, and convicted without ever being Mirandized– and it’s not a violation of your rights.

        Your Miranda rights have nothing to do with arrest procedure, and EVERYTHING to do with custodial interrogation procedure. Cops only have to Mirandize you when they QUESTION you– NOT when they arrest you. And even then, a failure to do so merely makes it LIKELY (but not a sure thing) that what you say will be disallaowed as evidence in court– SCOTUS has carved out some limited exceptions for statements of un-Mirandized subjects who spectacularly fail to claim their Fifth Amendment rights.

        So if the Brevard County cops are arresting folks for crimes that don’t require any questioning or interrogation… those arrestees need never be Mirandized.

        (I write this as a former Brevard County resident. I’m WELL aware of the good-ole-boy system down there, and I wouldn’t be surprised if the new sheriff is just as corrupt and full of shit as his predecessors. But not being read your rights upon arrest is not proof of that.)

            You might just want to look up from your “plain English” reading of the Constitution & read up on some of the Major Civil Rights rulings by the SCOTUS over the past 75 years or so. You will find the world a LOT less confusing, if you bother to educate yourself a bit.

Many of those out on the street filming the cops were not even from Fullerton but evidently were imported in from other local cities, but I thank them.

          My solution is to not burn down and/or disband a police department. If the community believes and has proof that there is corruption, contact the US Attorney and or the California Attorney General’s office.

There was a measure on the ballot awhile ago to completely disband the Fullerton P.D. but it didn’t pass and that could very well be due to the rigged voting system. Maybe after all the facts come out in the upcomming civil trial the people of Fullerton will attempt to vote once again to disband the Fullerton P.D. until a more healthy alternative police force can be decided upon. If the Fullerton pig house even lasts that long.

          The Police Department in Melbourne Beach Florida was shut down for corruption and Melbourne Beach didn’t collapse into chaos! That’s ridiculous! Like citizens can’t handle them selves without the police. t’s funny during every crises, disaster etc…who really is the first responders always? The citizens!       Nobody in Brevard County Florida the 18th Judicial Circuit is ever, ever read their rights and I’ve tried under two elected Sheriffs to train or force their Deputies to do this! I made it a public request of the newly elected Sheriff on talk radio, he just blew it off along with Bill Mick the talk show host, who beat a guy in handcuffs when he was a cop in West Virginia! I’ve brought it up in front of the courts also. I have documented video of everyone I’ve asked out in front of the courthouse if they’ve ever been read their rights! On video no was the answer bare none! That’s America Strong!

        Cops aren’t REQUIRED to read you your rights upon arresting you. It’s perfectly possible to be arrested, arraigned/indicted, tried, and convicted without ever being Mirandized– and it’s not a violation of your rights.

        Your Miranda rights have nothing to do with arrest procedure, and EVERYTHING to do with custodial interrogation procedure. Cops only have to Mirandize you when they QUESTION you– NOT when they arrest you. And even then, a failure to do so merely makes it LIKELY (but not a sure thing) that what you say will be disallaowed as evidence in court– SCOTUS has carved out some limited exceptions for statements of un-Mirandized subjects who spectacularly fail to claim their Fifth Amendment rights.

        So if the Brevard County cops are arresting folks for crimes that don’t require any questioning or interrogation… those arrestees need never be Mirandized.

        (I write this as a former Brevard County resident. I’m WELL aware of the good-ole-boy system down there, and I wouldn’t be surprised if the new sheriff is just as corrupt and full of shit as his predecessors. But not being read your rights upon arrest is not proof of that.)
